APEL PLEADS GUILTY AND IS CHARGED



A 24 year-old Moberly Man, Matthew Wayne Apel, has pled guilty to one charge of felonious restraint, a Class C Felony, and one charge of domestic assault. Apel had previously pleaded not-guilty to the charges, but at a motion hearing Wednesday, he withdrew his earlier plea and admitted to the charges.

Judge Scott Hayes sentenced Apel to 3 years incarceration on the charge of felonious restraint. That time is to be served consecutive to a Monroe County case in which Apel was given probation on a single count of assault in the second degree. That probation was revoked and Apel was ordered to serve 7 years in the Missouri Department of Corrections. The sentences will be served pursuant to Apel taking part in a 120 day treatment program. Apel was also sentenced to 120 days in Randolph county jail with credit for time served on the charge of 3rd degree domestic assault.

The Moberly Police Department's probable cause statement says the April incident happened when Apel returned from a bar and asked his girlfriend if she was speaking to another man. He then demanded to see her phone. The statement quotes the woman as saying she locked the bathroom door to get away from Apel, but he picked the lock and tried to shove her into the tub. Detectives say the woman was eventually able to run outside and call police. The statement quotes the woman as saying she had been dating Apel for more than a year, and that he's been violent toward her in the past. She described Apel as "uncontrollable". The police report says Apel was uncooperative with detectives after the incident, and allegedly told one officer "You're lucky I'm in handcuffs".

In addition to the above assault charges, online court records indicate Apel was convicted in 2008 of misdemeanor marijuana possession, and misdemeanor DWI in 2009.
