A Fayette man convicted of five sex crimes is scheduled to be sentenced Thursday afternoon in Randolph County Circuit Court.
52-year-old Dale Smiley was convicted in June of second degree statutory sodomy, sexual abuse and sexual misconduct involving a child under 15, all felonies. He was also convicted of two misdemeanor counts of sexual misconduct. The incidents happened in June 2011 in Howard County, and the case was moved to Randolph County on a venue change.
The jury deliberated about two hours this summer before returning the five guilty verdicts. Smiley faces a maximum sentence of 18 years when he's sentenced this afternoon in Huntsville. There were three juvenile victims in this case. Because Smiley is a convicted sex offender, Judge Scott Hayes has ordered him jailed without bond. In addition to the prison sentence, Smiley also faces lifetime supervision and will have to register as a sex offender for the rest of his life.
