MOBERLY BROTHERS CHARGED WITH ASSAULT FOR 2009 INCIDENT



The Missouri Attorney General's office has filed first degree assault charges against two Randolph County brothers accused of a brutal 2009 incident in downtown Moberly.

36-year-old Johnnie Dustin Pollard and 33-year-old Joshua Caleb Pollard have been charged with the class A felony. Attorney General Chris Koster's spokeswoman, Nanci Gonder, tells GoodRadio Koster's office has been appointed as special prosecutor. The Pollards are scheduled to be arraigned September 5 before Judge Mason Gebhardt in Randolph County Circuit Court. While they've been released from jail, the courts have banned the Pollards from having contact with the victims or witnesses in the case.

The Moberly Police Department's probable cause statement says the September 2009 incident happened in the 200 block of north Fifth Street. A witness told detectives that she and the male victim were attacked by Johnnie and Joshua Pollard. The statement says the male victim required emergency eye surgery. The brothers told investigators the incident began when the male victim began "flipping them off" at their business on north Fifth Street. Johnnie Pollard told detectives he and his brother told the man they didn't want any problems, but that the man stated "No we have a problem" and lunged at Johnnie.

The statement indicates three other witnesses provided statements to police.
